Durham Mayor Steve Schewel\u2019s <\/span>\u201cstay-at-home\u201d order<\/span><\/a> issued Wednesday requires city residents to stay at home unless they have very specific, approved reasons to leave.\u00a0<\/span><\/p>\n

The document is\u00a0intended to prevent a global pandemic from spreading serious illness and loss of life here.<\/span><\/p>\n

Italy has been ravaged with nearly 75,000 coronavirus cases and about 7,500 deaths. The United States could follow that path if communities don\u2019t act to protect their residents, the mayor said.
\n<\/span><\/p>\n

“We are fortunate that the numbers in North Carolina and Durham are still low and we hope to keep it that way,” Schewel said during a press conference Wednesday.
\n<\/span><\/p>\n

Yet many people, particularly young people, had been \u201cunhealthy and unsafe\u201d by gathering in large numbers rather than practicing social distancing.<\/span><\/p>\n

Schewel\u2019s <\/span>order<\/span><\/a> is similar to others across the country <\/span>affecting more than 100 million Americans<\/span><\/a>. But different states, cities and counties are customizing them to a degree. <\/span>
\n<\/span>
\n<\/span>Schewel said he closely crafted Durham\u2019s 14-page order with city attorney Kim Rehberg while looking over orders from <\/span>Mecklenburg County<\/span><\/a>, home to Charlotte, and the village of <\/span>Clemmons<\/span><\/a>, near Winston-Salem, because both apply in North Carolina.\u00a0<\/span><\/p>\n

All three orders ban public and private gatherings of more than 10 people. They require non-essential businesses to close. Grocery stores and pharmacies are among those exempt, along with restaurants serving take-out, drive-through and delivery meals only. Gas stations and other commerce vital to transportation can remain open. \u00a0<\/span><\/p>\n

But Durham\u2019s order differs from the others in this state and elsewhere in the country a bit. Here are five ways.<\/span><\/p>\n

You probably won\u2019t get arrested for violating the order\u00a0<\/b><\/p>\n

Maryland isn\u2019t messing around with its coronavirus response.\u00a0<\/span><\/p>\n

Gov. Larry Hogan <\/span>said<\/span><\/a> last week that police were prepared to arrest people for violating restrictions on businesses and gatherings even before he issued guidance <\/span>similar<\/span><\/a> to \u201cstay at home\u201d orders across the country.\u00a0<\/span><\/p>\n

Schewel skipped a law-and-order tone when he announced Durham\u2019s order.\u00a0<\/span><\/p>\n

Police have the power to enforce the order, he said, but the plans are not to arrest, cite or penalize anyone for violating it. Schewel didn\u2019t rule out further action being taken for egregious offenses, though.\u00a0<\/span><\/p>\n

New York Governor Andrew Cuomo, contending with the country\u2019s worst outbreak, struck a different tone in announcing his order.\u00a0<\/span><\/p>\n

\u201cThese provisions will be enforced. These are not helpful hints,\u201d Cuomo <\/span>said<\/span><\/a>. \u201cThese are legal provisions.\u201d<\/span><\/p>\n

Not a ‘shelter-in-place’ order<\/b><\/p>\n

Before digging into the details of Durham\u2019s order, Schewel was careful to distinguish it from a \u201cshelter-in-place\u201d<\/span> requirement like one California <\/span>implemented<\/span><\/a> last week.\u00a0<\/span><\/p>\n

The term \u201cshelter-in-place\u201d is often associated with shooters and nuclear attacks. This name might engender fear, he explained.\u00a0<\/span><\/p>\n

\u201cThis isn’t something we need to be afraid of if we act,” Schewel said.\u00a0<\/span><\/p>\n

No explicit curfew<\/b><\/p>\n

As part of \u00a0its \u201csafer-at-home\u201d order, Hillsborough County in Florida, home to Tampa, <\/span>will implement a mandatory curfew<\/span><\/a> between 10 p.m. and 5 a.m. on weekdays and for 24 hours on weekends.<\/span><\/p>\n

Durham\u2019s approach, on the other hand, doesn\u2019t specify hours. It bans residents from being in public or partaking in business in public, except for travel for exempted essential purposes, at all times.\u00a0<\/span><\/p>\n

New Jersey implemented a similar policy, but Gov. Phil Murphy described on Saturday it as a 24-hour curfew.\u00a0<\/span><\/p>\n

\u201cWe want you off the roads. That’s basically 24 hours. We don’t want you out there, period,\u201d Murphy <\/span>said<\/span><\/a>.\u00a0<\/span><\/p>\n

Durham\u2019s order is hyper-detailed<\/b><\/p>\n

Durham\u2019s stay-at-home order is 14 pages long, close in length and similar in wording to Mecklenburg\u2019s 13-page document.\u00a0<\/span><\/p>\n

Other jurisdictions have been much more concise. California\u2019s finishes in <\/span>two pages<\/span><\/a>.\u00a0<\/span>Then again, Ohio\u2019s runs a whopping <\/span>23 pages<\/span><\/a>.\u00a0<\/span><\/p>\n

The Durham order brings lots of specificity when describing exemptions, which include golf and tennis, with social distancing required. Golf is <\/span>deemed<\/span><\/a> \u201cnon-critical\u201d in some parts of Florida. Mecklenburg allows it. Clemmons is silent on that sport.<\/span><\/p>\n

Weddings, funerals allowed\u00a0<\/b><\/p>\n

Washington State, which also has been hard hit, has <\/span>canceled weddings and funerals<\/span><\/a>. Most jurisdictions, including Durham, do not go that far.\u00a0\u00a0<\/span><\/p>\n

Durham is allowing weddings and funerals, granted that they follow relevant restrictions in the order.<\/span><\/p>\n

This indicates those with only 10 or fewer people practicing social distancing will be allowed.<\/p>\n

Durham\u2019s order goes into effect Thursday at 6 p.m. and runs through April 30. Mayor Schewel stressed that it could be extended or shortened.\u00a0<\/span><\/em><\/p>\n
